These Terms and Conditions set out the basis on which Waste Clearance Notting Hill provides waste collection and related services to customers. By booking a collection, requesting a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

These terms apply to domestic and commercial customers within our service area and are intended to comply with applicable laws and regulations in England and Wales. Please read them carefully before placing a booking.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, company or organisation requesting waste clearance or related services from Waste Clearance Notting Hill.

Company, we, us or our means Waste Clearance Notting Hill, the provider of waste collection and clearance services.

Services means the waste removal, junk collection, rubbish clearance, recycling, loading, transportation and associated services that we agree to provide to the Customer.

Premises means the address or location at which the Services are to be carried out.

Waste means the items, materials, rubbish, junk or other matter that the Customer requests us to remove, subject to any exclusions set out in these Terms and Conditions or under applicable law.

Scope of Services

We provide waste clearance and collection services, including the removal of general household waste, garden waste, light construction waste, furniture, appliances and other non-hazardous items, subject to our operational capabilities and legal restrictions.

We reserve the right to refuse to collect any waste that we reasonably believe to be hazardous, illegal, unsafe to handle, contaminated, excessively heavy, or otherwise unsuitable for our Services. This may include, without limitation, asbestos, chemicals, clinical waste, biological waste, gas bottles, oils, paints, solvents, tyres, and certain electrical equipment.

We may from time to time update or change the range of Services offered. Any such changes will not affect confirmed bookings that have already been accepted, unless required by law or for safety reasons.

Booking Process

Customers may request a booking by telephone, email, online form or any other method we make available. When requesting a booking, you must provide accurate and complete information about the type and approximate volume or weight of waste, access to the Premises, any parking restrictions, and any other relevant details.

We may provide an estimated price based on the information you supply. This estimate is not binding if the actual waste or site conditions differ from what was described. The final price will be confirmed on site once our team has assessed the waste and the access arrangements.

Your booking is considered accepted and a contract is formed when we confirm the date, time window, and estimated price, and you indicate your acceptance, whether verbally or in writing. We may refuse any booking request at our discretion.

It is your responsibility to ensure that someone authorised is present at the Premises at the agreed time to grant access, confirm the items to be removed, and approve any variations in price in accordance with these Terms and Conditions.

Access and Parking

You must ensure that safe, adequate access is available to our vehicles and operatives at the Premises during the agreed time window. This includes ensuring that any gates, doors, stairwells and lifts are accessible and in working order.

You are responsible for obtaining any necessary permits or authorisations required for parking or access to the Premises. If pay-and-display parking or similar charges are required, these will be added to your final invoice.

If we are unable to carry out the Services due to lack of access, incorrect address details, unsafe conditions, or failure to obtain necessary permits, this may be treated as a late cancellation, and you may be liable for a call-out or cancellation fee as described in these Terms and Conditions.

Pricing and Quotations

Prices for our Services are generally based on the volume and type of waste collected, the labour required, the time spent on site, and any additional costs such as parking or special disposal fees.

Any quotation or estimate we provide prior to arrival is based on the information you provide and is indicative only. The actual price will be confirmed once our team has inspected the waste and access conditions. If the waste volume, type or difficulty of removal significantly differs from what was described, we may adjust the price accordingly.

If the revised price is higher than the initial estimate, you will have the option to decline the Service. In that case, we reserve the right to charge a reasonable call-out fee to cover our travel and administrative costs.

All prices are stated in pounds sterling and, where applicable, are inclusive of VAT unless we clearly state otherwise.

Payments

Payment is due on completion of the Services, unless we have agreed alternative payment terms in writing in advance. We may accept payment by cash, bank transfer, card or other methods notified to you at the time of booking.

For commercial customers or larger projects, we may request a deposit or full prepayment before commencing work. Any required deposit will be communicated at the time of booking.

If payment is not received when due, we reserve the right to charge interest on the overdue amount at the statutory rate, to recover reasonable debt collection costs, and to suspend or cancel any further Services.

Title in any removed waste passes to us once payment for the relevant Services has been received in full, subject to compliance with applicable waste regulations.

Cancellations and Amendments

You may cancel or amend your booking by contacting us directly. To avoid charges, we usually require at least 24 hours notice before the scheduled arrival time. Where less than 24 hours notice is given, we may charge a cancellation fee to cover the costs of scheduling and travel.

If our team arrives at the Premises and is unable to carry out the Services due to circumstances within your control, including lack of access, absence of an authorised person, or health and safety concerns, we may treat this as a same-day cancellation and charge a call-out or cancellation fee.

We will use reasonable efforts to arrive within the agreed time window, but times are estimates and may be affected by traffic, weather, operational issues or other factors beyond our control. In the event of substantial delay, we will seek to inform you as soon as reasonably possible and rearrange if necessary. We shall not be liable for any loss resulting from delays outside our reasonable control.

We reserve the right to cancel or reschedule a booking at any time if we consider it necessary for safety, legal compliance, or operational reasons. If we cancel a confirmed booking and cannot offer a suitable alternative, any prepayments you have made for that booking will be refunded.

Customer Obligations

You must ensure that the waste to be removed is clearly identified and separated from any items that are not to be taken. We are not responsible for removing items that you did not clearly designate as waste, nor are we responsible for leaving on site any items that were not clearly excluded.

You must inform us in advance if any of the waste may be hazardous, sharp, fragile, or otherwise poses a specific risk to our operatives or third parties. You must not deliberately conceal hazardous or restricted items within general waste.

Where we have agreed to enter internal areas of your property, you must ensure that the environment is safe and that we have adequate space to move and load items. You must keep children, pets and other persons at a safe distance while the Services are being carried out.

Waste Handling and Regulations

We operate in accordance with applicable UK waste management regulations and environmental laws. All waste collected will be transported and disposed of using authorised facilities in line with legal requirements.

We may, at our discretion, seek to recycle or re-use items where possible. However, we do not guarantee that any specific item will be recycled or reused.

If it is discovered that the waste contains items that are illegal to handle, transport or dispose of under applicable law, we reserve the right to refuse to remove such items and may report the matter to the appropriate authorities where required.

By using our Services, you warrant that you have the right to dispose of the waste and that it is not stolen, unlawfully obtained or otherwise subject to third-party ownership claims.

Liability and Limitations

We will exercise reasonable care and skill in the provision of the Services. However, you acknowledge that waste clearance can involve moving bulky and awkward items through tight spaces, stairs and doorways, and some minor scuffs or marks are sometimes unavoidable. We will not be liable for minor cosmetic damage that arises as a natural consequence of carrying out the Services with reasonable care.

You are responsible for protecting floors, walls and fixtures where you consider them particularly vulnerable. You may request that we do not attempt to remove any item if you are concerned about the risk of damage.

We shall not be liable for any loss of profits, loss of business, loss of opportunity, or any indirect or consequential loss arising out of or in connection with the Services. Our total liability to you in respect of any claim arising from a single booking shall not exceed the total amount paid or payable by you for that booking, except in cases where liability cannot be limited by law.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Insurance

We maintain insurance that is appropriate for the type of waste collection and clearance services we provide. Details of our insurance cover are available on request.

If you believe that damage has occurred as a result of our Services, you must notify us as soon as reasonably possible and, in any event, within 48 hours of completion of the work. We may require reasonable evidence of the alleged damage and access to inspect the affected areas.

Complaints and Disputes

If you are dissatisfied with any aspect of our Services, you should raise the issue with us promptly by contacting our customer service team. We will investigate and aim to resolve your complaint in a fair and timely manner.

If a dispute arises that cannot be resolved through our internal complaints process, you and we agree to attempt to resolve it through negotiation before considering any formal legal action.

Data Protection and Privacy

We collect and process personal information such as your name, contact details and service address in order to manage bookings, deliver Services, process payments and handle customer communications. We handle personal data in accordance with applicable data protection laws in the UK.

We will only use your personal information for legitimate business purposes, and we will not sell your details to third parties. We may share information with service partners or authorities where necessary to carry out the Services, comply with legal obligations, or protect our rights and interests.

Intellectual Property

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services, except where mandatory law provides otherwise.
